The Evolving Legal Architecture of EU Social Clauses

Abstract

This Article examines the evolving legal architecture of Trade and Sustainable Development (TSD) clauses embedded in the EU Free Trade Agreements (FTAs), focusing on their legal structure and enforcement mechanisms. The paper argues that TSD chapters are not merely symbolic sustainability appendices, but a distinct and evolving legal instrument within EU trade law, integrating labour, environmental, climate and responsible business concerns into trade regulation. Employing a doctrinal and comparative methodology, the Article reconstructs the historical emergence of EU social clauses, examines the legal object and types of obligations embedded in TSD chapters, and analyses their institutional and enforcement design. The study concludes that EU TSD clauses have evolved from procedurally insulated commitments into an increasingly “juridified”, though still hybrid, framework of sustainable trade governance.
